1.1. XELENTORIZONTE LDA NIPC nº 510955339 with fiscal address at Rua da Tapada 16 2655-015 Carvoeira is the legitimate owner of the GSPA online store, whose domain can be found at www.gspa.pt.

OBJECT AND SCOPE

3.1. These General Terms and Conditions of Sale exclusively regulate the purchase and sale made in the GSPA online store, between the Final Consumer as buyer and XELENTORIZONTE LDA as seller, and apply to all visitors to the www.relaxin.pt website, as well as to any commercial transaction made through this online store.

3.2. Browsing and purchasing any product in the GSPA online store implies acceptance of these general conditions of use and contracting.

3.3. The GSPA reserves the right to change these conditions of use and contracting in order to adapt them to the applicable legislation, without prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services, and any change will always be published on the website www.gspa.pt.

3.4. All the content and information on www.gspa.pt is the property of XELENTORIZONTE LDA or its commercial partners as the legitimate owners, and the use, reproduction, copying and dissemination of logos, texts, images and videos contained therein is therefore prohibited.

CONDITIONS OF USE

The end-consumer must provide the GSPA with a correct and complete e-mail or postal address or other contact details and agrees that the GSPA may contact him/her using these details if it deems it appropriate.

4.1. Any visitor to the GSPA online store undertakes to comply with and respect these general conditions, in particular by observing the following obligations:

  1. It is forbidden to introduce, store or disseminate through the gspa.pt online store defamatory, obscene, insulting, xenophobic and/or any other type of content that violates the general principles of law and public order;
  2. Save, and do not disclose, your password for entering the site in order to prevent third parties from accessing your account and personal data;
  3. Do not use false identities;

Provide your personal details and correct addresses so that GSPA can process invoices properly.

4.2. The end consumer is solely responsible for the accuracy of the personal data communicated to the GSPA and undertakes to immediately enter and report any changes via his/her registration account in the online store www.relaxin.pt.

SENDING VOUCHERS

5.1. VOUCHERS ordered from the GSPA online store will be sent to the email address provided by the buyer.
5.2. GSPA will only process an order placed by a customer once payment has been confirmed.
5.3 Orders placed in good order will be sent to the email address within a maximum of 12 hours.
5.4. Any claim for non-receipt of an order, for which the customer is not responsible, must be made within a maximum of 10 days from the date of payment.

CANCELATIONS, CANCELLATIONS, RETURNS, EXCHANGES AND REFUNDS

6.1. Refunds must be made by the same means of payment used for the payment, without prejudice to the customer, within a maximum of 14 days. If the refund is requested using a different method, you will not have to reimburse any additional costs.
6.2. In the event of an exchange and/or return, the following procedure must be followed:

  1. E-mail to gspa@relaxin.pt with order details
  2. If the product you have purchased has a lower value than the item you wish to exchange, you will be asked for the details to make a bank transfer of the difference between the values of the items.
  3. Upon receipt of your request by e-mail, the GSPA will analyze the request and reply to your e-mail.

PAYMENT METHODS

7.1. The available payment methods will be displayed in the online store www.gspa.pt. If you are unable to pay using the methods shown, you should contact us by email so that we can analyze the possibility of granting another form of payment.

7.2. You can pay for your products using your usual credit cards, ATM references or MBWay.
7.3. For payments using a credit or debit card, all details (such as the card number, expiry date or security code) will be sent by the Encrypted Protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by the GSPA, except to carry out the necessary operations for purchase or refund, in the case of return in accordance with the exercise of the right of return, or for reporting cases of fraud to the police.
7.4. We urge you not to try to pay by any other means not specified in the online store www.gspa.pt. If you attempt to do so, the GSPA cannot be held liable for loss of payment or any other damages that may result.

PRICES

8.1. The GSPA provides information on the essential characteristics of the products in the online store www.gspa.pt, using descriptions obtained from its suppliers. Photographs or videos of the products we sell meet the best market standards.
8.2. The prices, products and shipping costs shown on the site are in euros and include Value Added Tax (VAT).
8.3. The prices of the products shown on the site are subject to change. The GSPA reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

CONDITIONS APPLICABLE TO PROMOTIONAL CODES (DISCOUNTS) and coupons

10.1. When used in accordance with the rules laid down, a promotion code entitles the Consumer to take advantage of a promotion/discount relating to the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/promotional campaign.
10.2. Promotional codes are personal and non-transferable and can only be used for online purchases made at www.gspa.pt. The sale, exchange or donation of a promotional code is not permitted. The customer holding the promotional code may not upload or make available a promotional code on any website or other public form of offer, donation, sale or exchange. Promotional codes may not be used for commercial purposes.
10.3. The use of a promotional code is limited to one use per product and per order. Promotional codes cannot be combined with any other promotions or special offers.
10.4. The GSPA reserves the right to immediately invalidate the promotional code issued if it suspects that a promotional code is being used in breach of the above conditions.

10.5 After purchasing a voucher on the website www.gspa.pt, the holder of the voucher must book the service until it expires by contacting the contacts mentioned in point (2.1).

10.6 Upon expiry, the GSPA reserves the right not to accept the scheduling of the service and may charge an activation fee.

RESPONSIBILITY

11.1. GSPA shall only be liable for damages suffered by the Buyer in the event that such damages result from attributable breaches of GSPA’s contractual obligations towards the End Consumer, or in the event that liability results from applicable statutory law.
11.2. In the event that the Buyer has suffered damage in connection with the activity of the website, GSPA’s liability shall be limited to damage to the products of the online store www.gspa.pt and to reasonable and verifiable costs incurred by the Buyer as a result of GSPA’s breach of these General Terms and Conditions of Sale.
11.3. The GSPA is not liable for damages resulting from incorrect information on the website.
11.4. The GSPA assumes no responsibility for damages or computer viruses that may infect your computer while browsing our website.

INTELLECTUAL PROPERTY

12.1. All the content and information contained in the online store is the property of the Store or its commercial partners as legitimate owners, and therefore the use, reproduction, copying and dissemination of logos, texts, images and videos contained therein is prohibited.
12.2. If the User wishes to use information or materials from the site, he/she must obtain prior written authorization from the GSPA.

DISPUTE RESOLUTION AND APPLICABLE LAW

13.1. These General Terms and Conditions of Sale and all disputes arising in connection with these general conditions, including their validity, the use of the www.gspa.pt website or any contract of purchase on it shall be governed by Portuguese law.
13.2. In the event of a dispute regarding the interpretation or execution of these General Terms and Conditions of Sale, GSPA and the Buyer undertake to endeavor to reach an amicable solution that is fair and adequate, within a maximum of 60 (sixty) days from receipt of the communication addressed to that effect by any of the parties involved.
13.3. GSPA is happy to answer any questions or resolve any problems relating to the products in the online store. In the event of a dispute regarding contractual obligations resulting from purchase and sale contracts, the consumer may resort to the following Alternative Dispute Resolution Body – CNIACC.
